Personal Information under Arizona law also includes any other category of personal information defined within the Arizona Revised Statutes (A.R.S.), with financial information protections detailed in multiple statutes covering various contexts, from general consumer privacy to specific industry practices. Key Arizona laws protecting financial information include: The Financial Information Privacy Act. This act is located in A.R.S. Title 6, Chapter 16.
It prohibits a financial institution from selling, sharing, or disclosing a customer's personal financial information to a non-affiliated third party without the customer's explicit "opt-in" consent.
The act defines personal financial information broadly to include records related to a deposit or share account that show transactions.
It imposes civil penalties for violations, including fines for knowingly and willfully obtaining or misusing private financial information.
Exceptions to this rule include disclosures authorized by the customer, made to regulatory agencies, or used for purposes such as debt collection and credit reporting.
Financial institution records
A.R.S. § 6-129 specifies the confidential nature of a financial institution's records.
Most records related to department examinations, inquiries, and investigations are confidential and cannot be made public.
The Department of Insurance and Financial Institutions (DIFI) explicitly states that most records concerning licensed financial institutions are confidential and not subject to public disclosure.
Federal regulations
Arizona also operates under applicable federal laws that govern financial information, such as the Gramm-Leach-Bliley Act (GLBA), which addresses consumer financial privacy within the financial services industry.
For example, the University of Arizona, as a financial institution under GLBA, has a program to protect customer information
We refer to this category as “Other Data,” and it includes information such as financial information (bank account number, credit card number, debit card number), medical information, health insurance information, and insurance policy number.
